Terms of Service

Agreement to Terms

By accessing or using the services of AcePoint Westminster Landscaping, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our services.

Services Provided

AcePoint Westminster Landscaping provides professional landscaping services including lawn care, landscape design, hardscaping, irrigation systems, tree and shrub care, mulching, sod installation, and landscape lighting. We reserve the right to modify or discontinue any service at any time without notice.

Quotes and Estimates

All quotes and estimates provided are valid for 30 days from the date of issue. Prices may be subject to change based on material costs, site conditions, or project scope modifications. Final pricing will be confirmed in writing before work begins.

Payment Terms

Payment is due upon completion of services unless otherwise agreed in writing. We accept cash, check, and major credit cards. For larger projects, we may require a deposit before work begins. Late payments may be subject to a service charge of 1.5% per month.

Cancellation Policy

You may cancel scheduled services with at least 24 hours notice without penalty. Cancellations made with less than 24 hours notice may be subject to a cancellation fee. For ongoing maintenance contracts, 30 days written notice is required for termination.

Property Access and Safety

You agree to provide safe and clear access to all areas where services will be performed. You are responsible for marking any underground utilities, sprinkler lines, or other hidden obstacles. We are not liable for damage to unmarked utilities or obstacles.

Warranties and Guarantees

We guarantee our workmanship for 90 days from completion. Plant materials are guaranteed for 30 days when properly maintained according to our care instructions. We are not responsible for plant failure due to weather conditions, pests, disease, or improper care.

Limitation of Liability

Our liability is limited to the amount paid for the specific service in question. We are not liable for indirect, incidental, or consequential damages. We maintain appropriate insurance coverage and will work with you to resolve any legitimate claims promptly.

Weather and Delays

Services may be delayed or rescheduled due to weather conditions, equipment failure, or other circumstances beyond our control. We will make every reasonable effort to notify you of delays and reschedule services as soon as possible.

Intellectual Property

All landscape designs, plans, and creative work remain the intellectual property of AcePoint Westminster Landscaping. You may not reproduce or use these materials without our written permission.

Dispute Resolution

Any disputes will first be addressed through good faith negotiation. If resolution cannot be reached, disputes will be handled through binding arbitration in Westminster, California, in accordance with California state law.

Changes to Terms

We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated revision date. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.
